Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the bySeller website, mobile applications, and related services (together, the “Platform”). By creating an account, posting a listing, or using the Platform, you agree to these Terms.

1. Who we are

bySeller operates an online classifieds marketplace that lets people list, browse, and contact each other about goods and services in Canada. The Platform is operated from Canada.

2. The Platform is a venue

We provide tools for buyers and sellers to find each other. Unless we clearly say otherwise, we are not the seller of listed items, we do not take possession of items, and we are not a party to any sale, trade, or other arrangement between users. You deal with other users at your own risk. You are responsible for inspecting items, confirming identity, arranging payment and delivery, and complying with the law.

3. Eligibility and accounts

• You must be at least 18 years old, or the age of majority in your province or territory, to create an account or complete a transaction.
• You must provide accurate information and keep it up to date.
• You are responsible for activity on your account. Keep your password and sign-in methods confidential.
• We may refuse, suspend, or close an account if we reasonably believe these Terms or the law have been broken.

4. Listings

• You may only list items or services you are legally allowed to sell.
• Listings must be truthful, in the correct category, and include a fair description of condition, price, and location.
• Do not post misleading photos, bait-and-switch prices, or content that impersonates another person or business.
• We may edit, hide, refuse, or remove a listing at any time, including for safety, legal, or policy reasons.
• Paid listing or featured-ad packages last for the period shown at checkout. Unused time is not automatically refunded unless required by law or stated in a refund policy.

5. Prohibited content and conduct

You must not use the Platform to:

• Sell or promote illegal items, stolen goods, weapons, explosives, or other restricted products under Canadian law.
• Post hate, harassment, sexual content involving minors, or other unlawful content.
• Scam, phish, spam, or collect personal information from other users for a purpose they did not agree to.
• Interfere with the Platform, scrape it in an abusive way, or try to bypass security or fees.
• Post the same listing repeatedly in a way that harms other users’ experience.

6. Fees and payments

Browsing and some listings may be free. Optional paid features (for example featured ads or listing packages) are charged through the payment provider shown at checkout. Those providers process your payment details. Taxes may apply. If a charge fails or is reversed, we may suspend the related feature.

7. Messages and safety

Messages you send through the Platform may be stored to operate the service and to review reports of abuse. Meet in a safe, public place when exchanging items in person. Never send money to someone you have not verified, and do not share banking passwords or one-time codes.

8. Intellectual property

The Platform’s design, software, and trademarks belong to bySeller or its licensors. You keep ownership of content you upload, and you grant us a non-exclusive licence to host, display, and distribute that content as needed to operate the marketplace (including caching, resizing images, and showing listings to other users). You confirm you have the rights to grant that licence.

9. Privacy

How we collect and use personal information is described in our Privacy Policy. By using the Platform, you acknowledge that policy.

10. Disclaimers

The Platform is provided “as is.” We do not guarantee that listings are accurate, that a user is who they claim to be, or that a transaction will complete. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the extent permitted by applicable Canadian law, bySeller is not liable for lost profits, lost data, or indirect or consequential loss arising from your use of the Platform or from dealings between users. Our total liability for a claim relating to the Platform is limited to the greater of CAD $50 and the amount you paid us for paid features in the 12 months before the claim. This does not limit liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence where that limit is not allowed.

12. Indemnity

You agree to indemnify bySeller against claims, damages, and reasonable legal costs arising from your listings, your content, or your breach of these Terms, except to the extent caused by our own negligence or willful misconduct.

13. Changes and termination

We may update these Terms by posting a new version on the Platform. The “Effective date” will change. Continued use after a change means you accept the updated Terms. You may stop using the Platform and close your account at any time. We may stop offering all or part of the Platform with reasonable notice where practical.

14. Governing law

These Terms are governed by the laws of Canada and of the province or territory in which you reside, without regard to conflict-of-law rules. Courts in that province or territory have jurisdiction, except where applicable law requires otherwise.
