Privacy Policy

bySeller (“we”, “us”) operates a classifieds marketplace for buyers and sellers in Canada. This policy explains what personal information we collect, why we collect it, and how you can exercise your rights.

1. What we collect

Depending on how you use the Platform, we may collect:

• Account information: name, email, phone number, username, password or sign-in tokens, profile photo, and language preference.
• Listing information: titles, descriptions, photos, videos, prices, category, and the city or area you choose to show.
• Location: a default map location, a location you search or pin, and (if you allow it) an approximate location from your device so nearby listings can be shown.
• Messages: conversations you send through the Platform, including reports of abuse.
• Technical data: IP address, browser or app type, device identifiers, crash logs, and pages or screens you visit.
• Payment data: if you buy a listing package or featured ad, the payment provider collects card or wallet details. We typically receive a transaction status, amount, and a reference — not your full card number.
• Support: emails or forms you send us.

We do not require a social insurance number to use the marketplace.

2. How we use it

We use personal information to:

• Create and secure your account (including sign-in through email, phone, Google, or Apple when those options are enabled).
• Publish and display your listings and profile information that you choose to make public.
• Show relevant cities, search results, and maps.
• Process paid features and prevent fraud.
• Send transactional messages (for example verification codes, listing status, or replies). Marketing messages are sent only where permitted, and you can opt out.
• Moderate content, enforce our Terms, and keep users safer.
• Improve the Platform, fix bugs, and understand which features are used.
• Meet legal, tax, and accounting duties.

We rely on the purposes you would reasonably expect for a marketplace, on your consent where required (for example optional device location or marketing), and on our legitimate need to operate and secure the service.

3. When we share it

We do not sell your personal information. We may share it with:

• Other users: your public listing details, general location (city or area), and the contact method you enable (for example a chat or a phone number you choose to show).
• Service providers: hosting and file storage (including Amazon Web Services in Canada where configured), authentication and push notifications (for example Firebase), maps (for example Google Maps / Places), email or SMS providers, and payment processors. They may only use the information to provide their service to us.
• Authorities: if the law requires it, or to protect users, the Platform, or the public from harm or fraud.
• Business transfers: if we reorganize or transfer the business, information may move with it under this policy.

4. Cookies and similar tools

The website uses cookies and similar storage to keep you signed in, remember language and location, and measure traffic. You can block cookies in your browser, but some features may stop working. The mobile app uses similar device storage for sessions and preferences.

5. Location

City and map location help people find listings near them. You control how precise a location you put on a listing. Turn off device location in your phone or browser settings if you do not want us to use it. Search history and pinned map points may still be stored with your account if you save them.

6. Retention

We keep account and listing information while your account is open and for a reasonable period after you close it, so we can handle disputes, prevent abuse, and meet legal record-keeping rules. Backups and logs are kept for a limited time. You can ask us to delete your account; some information may remain if we must keep it by law or for an outstanding dispute.

7. Security

We use access controls, encrypted connections (HTTPS), and cloud security practices appropriate to a marketplace. No method of transmission or storage is perfectly secure. Please use a unique password and protect your device.

8. Your rights (Canada)

Subject to PIPEDA and other applicable Canadian privacy laws, you may:

• Ask whether we hold personal information about you and request access to it.
• Ask us to correct information that is inaccurate or incomplete.
• Withdraw consent where we rely on consent (this may limit some features).
• Ask us to delete your account or unused personal information, subject to legal exceptions.
• Complain to us first, and if you are not satisfied, to the Office of the Privacy Commissioner of Canada or your provincial privacy commissioner.

To make a request, email support@byseller.ca. We may need to verify it is you. We will respond within the time required by law.

9. Children

The Platform is not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has created an account, contact us and we will delete it.

10. Transfers outside Canada

Some providers (for example authentication, maps, or analytics) may process information on servers outside Canada, including in the United States. Those jurisdictions may have different privacy laws. We use providers we believe have appropriate safeguards. By using the Platform you understand that your information may be stored or processed in those countries.

11. Changes

We may update this policy by posting a new version on the Platform and changing the effective date. If a change is material, we will take reasonable steps to notify you (for example a notice on the site or an email).
